Plaintiffs filed a motion for reconsideration; hence, the matter will not be ripe for an appeal until the judge rules on that motion.

The Deere case's 404(c) analysis comports with that of Judge Ellis in the District Court decision in DiFelice. Fourth Circuit dicta threw some cold water on Judge Ellis' MPT comments, however. Posner pontification would be most welcome.
