This was requested by and proposed for a specific multiemployer plan that is frozen to new entrants and vastly overfunded. They were prepared to follow the pre-existing single employer rules. It was adopted to apply to any multiemployer plan, if Treasury can think of how to do it.

Unfortunately, by widening the scope of the provision and making its applicability dependent on Treasury regulations, the law may delay or impede its accessibility to the one plan that can make good use of it. I don't think there was a hidden agenda, I just think the JCT or whoever drafted it was a little overambitious.
